Sodsri: Jatuporn may be disqualified

Jatuporn Prompan, the No.8 candidate on the Pheu Thai party list, may be disqualified when elected if he is not allowed to temporarily leave the prison to vote on July 3, Election Commission member Sodsri Sattayaham said on Tuesday.

Mr Jatuporn, a United Front for Democracy against Dictatorship core member, is charged with terrorism in connection with the April-May violent protests of the red shirts last year and is being detained at Bangkok Remand Prison after his bail was revoked.

Mrs Sodsri said if Mr Jatuporn is not allowed to get out of the prison to vote, but is elected, the EC would possibly not endorse his election, she said.

    More info on Discussion 9.

    I've now trudged through the EC voting regulations. In short if Jatiporn does not vote he can be disqualified, BUT and it's a huge BUT, all he has to do is inform the EC either himself or his representative, why he missed the election within 60 days. Not such a big deal in reality.

    Disc 3 - Yes, the list just moves up one if a list member is disallowed.

    This will cause more problems than it solves. The court could have easily allowed him to vote - in jail. He is after all a sitting MP, like it or not. There will be a huge legal case about this. He has been disallowed to vote but has asked to vote, I'm not sure how the law will look at that. A lot depends on the outcome of the election. An absolute PTP majority and you will see the entire EC trading places with Jatiporn.

    This bigmouth deserves to be in jail one thousand times! So, there is no reason for a "special treatment". If he cannot get elected it will be his own fault and anyway, a parliament with an MP like Jatuporn is a disgrace for this country!

    If this means another PT party list member gets in instead, then I personally don't see much harm for PTP. (If it doesn't, that's more problematic.) But the laws should be scrutinized and followed accordingly.

    I do not see what the problem is.

    The police feel they have evidence he committed a serious crime. He is on remand for that crime.The courts will not allow him bail due to the serious nature of the crime. He lost his rights when he committed the crime. He is suffering the consequences of his own actions.

    Hiding for so long behind the amazing world leading Thai parliamentary immunity may have made him feel he was bulletproof forever.

    Well then - there is the solution for the Democrats - put all the PT candidates in Jail on Saturday and keep them from voting - then they are all disqualified. No need to roll the tanks, just blame the EC for it, so the country can go back to "normal" - as they always say.
