Nong Than to sue S'pore

SINGAPORE : Nitcharee Peneakchanasak, the 15-year-old school girl who lost her legs in a Singapore train accident, said on Saturday she intends to sue for S$4 million in compensation.

A Yahoo! News report from Singapore quoted the teenager as saying she has had legal advice during a visit to the city late last week with her father and sister.The lawsuit against train operator SMRT could come within weeks, but negotiations are under way to seek an out-of-court settlement, according to Ms Nitcharee's lawyers.Four million Singapore dollars is the equivalent of 97.2 million baht, or US$3.16 million.The SMRT decided last month that it would pay no compensation to the Thai student, on the basis that the accident that cut off her legs was her own fault.She...

    banmebkk, #2; I have never seen station edge barricages in an above ground Bangkok railway stations. I have never been to Japan or USA but have watched many TV programs and movies showing their above ground railway stations - no barricades. I have been to UK and France. Australia and New Zealand - no barricades in above ground railway stations. I have seen TV programs showing above ground railway stations in China during the pre-Chinese New Year rush - no barricades.

    Maybe you are referring to underground railway stations, where Singapore MRT does have glazed wall with automatic doors.

    geoffo, #1, babmebkk,#2; There is a lot of sympathy in Singapore for this very brave girl, and many members of the public made donations. However, SMRT and their Insurance Company are businesses, not charities.

    The legal process will continue and the result will depend on the evidence, including a CCTV recording which may reveal whether she fell or was pushed.

    Even if she fell, I would expect an out of court settlement to be agreed which would give her more than the initially offered S$5,000, which was simply a token offer which had to be made and rejected so that the legal proceedings could commence. You cannot have legal proceedings if there is no dispute to be dealt with.

    SMRT should have their insurance company cover for medical expenses and loss. Shame on them for offering such a low sum. In earlier reports, SMRT said they will cover her expenses and offer extra compensation, but they have decided to stay quiet after she received medical help. There is a good reason why countries such as Japan, Korea, Taiwan, and even China have barricades at high traffic stations.

    Thailand should have one on the bts platforms as well. Hope the little girl recover well.

    Singapore might be legally in the right but morally they are so far in the wrong this will end up costing them much more than SG$4million in lost goodwill and damage to their countries image.

    Just like the chewing gum episode where Singapore were in the right but handled it poorly this case will go on and on.

    I like Singapore , I enjoyed my years living there but I wish Nong Than every success against them.
