Geoffo: "in flagrante delicto" in this case means that a crime is committed while the police are there to witness it.
The quote about parliamentary immunity is directly from the Thai official translation of the constitution and is not just my personal interpretation.

D31 Bern1005 notes : unless he or she is arrested in flagrante delicto.". How much more flagrante delicto is standing over the victim with a smoking gun.

In any case , according to D31's summary MP's don't have immunity as so often claimed. They have Parliamentary protection at the pleasure of the PM which can be withdrawn at anytime. Of course it will never be withdrawn as that would require a conscience and guts - both non existent with this mob.

What amazes me is that a man who grabs a couple of tourists breasts gets arrested, but a man who shoots a woman, under what must be very suspicious circumstances, is protected by parliamentary privilege. No wonder so many rouges want to become politicians in Thailand. It is high time to change the law that protects these people.

The American media is reporting that the "secretary" is also the good Senator's ex-wife. Is this true? If so, it puts a whole new spin on the story. Their story also says that he had been separated from his wife (the victim) for a while but they were currently living together.

My first thought was did he end an affair that was getting sticky? Is this guy a PTP MP? Being from Mae Hong Son, I would guess so.

Uzi type submachine gun is an old crude bolt-action type, and is known to be prone to misfiring. So, it should only be chambered when you intend to fire it. So, it is entire possible that something tragic like this can happen. However, this senator has no business of carrying such weapon which he is not familiar with. Luckily that it didn't hurt or kill more people.

Legally, civilians here are not allowed to possess automatic and semi-automatic rifles (because of their uses as war weapons) but an "Uzi pistol" has been produced which is basically a semi-auto only Micro-Uzi with no folding stock.

If it really is an Uzi submachine gun then even if it was an accident he has still broken the law, but what are the chances of a senator getting punished with prison time for a crime?

"No member of the House of Representatives or Senator shall, during a session, be arrested, detained or summoned by a warrant for an inquiry as the suspect in a criminal case unless permission of the House of which he or she is a member is obtained or he or she is arrested in flagrante delicto."
