Teen crash driver gets suspended jail

An 18-year-old girl who was the driver of a sedan which collided with a passenger van on the Don Muang tollway in December 2010, causing the death of nine people, was given a suspended two-year prison sentence by the Central Juvenile and Family Court on Friday.

On the night of Dec 27, 2010, a Honda Civic driven by Orachorn "Praewa" Thephasadin Na Ayudhya, who was 16 at the time, collided with the passenger van on the elevated Don Muang tollway.

The van then crashed into a barrier near the Bang Khen exit. Passengers were thrown from the vehicle and fell several metres to the road below. Orachorn sustained minor injuries.

    old news but still the sickest injustice i have ever heard of.. a thai internet forum isn't the place to voice to voice real thoughts on this whole sorry story (how ironic).

    This is beyond disgraceful and my heart bleeds for the innocents here. I respect how much restraint and humility they have here. Simply mind blowing.

    Is there anything positive happening on the part of the victims now a couple of months down the line? Would be a shame if this story slipped into the archives forever now without any positives coming to light

    There is an issue of victim compensation. The Department for the Defense of Liberties and Human Rights will provide very inadequate compensation to the victims of this collision. Well, better than nothing, and let us work for more adequate compensation.
    Next, the rehabilitation of the perpetrator. Of course the suspended sentence is of no avail. Likewise, a sentence of a young girl to the Thai women's prison, never mind her family standing, is pointless, whether as a deterrent or as a measure of rehabilitation. There are other appropriate punishments, such as a lengthy period of community service to those with disabilities, or who suffer the consequences of such 'accidents'. I believe that this would really help the culprit to realise the enormity of her fault.
    And of course it is necessary to bring about legal reform to make adult parents responsible for the misdeeds of their children. And now, not in 'chaat naa bai bai'.

    As a minor she cannot be heald accountable for her actions. Her family who own the car should be charged with contributing to the delinquency of a minor causing death which should put them in jail for 20 years or so. Faliing to do so will only encourage this sort of behavior. She will suffer only if her family is in prison for her actions.

    D14 wrote "what do you have to do to go to jail in thailand"

    The answer is sadly simple. Be poor.

    Would like to know how you would comment on this case if one of your family members would be among the dead D17? For sure it would be totally different!

    Khun Abbub #29 & Khun Democrazy #30, Democracy is Majority Rule within the Rules of Law, which must begin at the top, i.e., the Prime Minister, President, or Chancellor, then going down the chain-of-command through his ministers, and etc, so on and so forth. In a real Democracy, the PM either steps up to the plate or down through resignation. However, TS chose neither, that's why massive numbers of people took to the streets protesting the failure of his leadership, marking the beginning of the end for him. Majority Rule outside the Rules of Law is Mob Rule, aka, Tyranny of the Majority, which continues to exist in Thailand as we speak, and this tragic accident is just a reflection of it.

    D.26 Spiceman talks about democracy and you come up with the coup.
    The law must be upheld equally on every person. That is the heart of a REAL democracy. The girl is responsible for 9 dead people and she walks free. This is ridiculous. But when another girl is caught with 10 yaba pills she goes to jail immediately.
    But the best example is in 2001 when Thaksin just made an honest mistake.

    Again, SPICEMAN in D26 refers "the country had become highly unstable, on the verge of anarchy with massive protests".

    "TS...serious corruption allegation against his Govt."

    Again, his right wing pro-military, anti-democratic POV shows clearly. What he ignores is:

    1) The country became even more unstable after the coup;
    2) He blames the TS government for the country "on the verge of anarchy", not on those creating the anarchy.
    3) The military sided with those creating what SPICEMANS refers to as anarchy;
    4) The anarchy was mainly a tiny group of PAD;
    5) Corruption was rife before TS was even born, and;
    6) Corruption after the coup, according to all research, became far worse.
