Jeng's bail request rejected

The Criminal Court on Wednesday rejected a request for the release on bail of red-shirt Yossawaris Chuklom, alias Jeng Dokchik, on the grounds there is no solid guarantee he will not again break the bail conditions.

The request was filed by Winyat Chartmontree, a lawyer for the United Front for Democracy against Dictatorship (UDD), on Sept 3 after the Criminal Court revoked his bail on Aug 22 for criticising and intimidating Constitution Court judges.

The lawyer filed a fresh bail request and offered 600,000 baht as collateral.  Justice Minister Pracha Promnok and former deputy interior minister Sermsak Pongpanich testified as witnesses on his behalf in court, guaranteeing that Mr Yossawaris would be well behaved if released.

    Look, it's not rocket science, violating bail conditions in general might have some excuse or justification to persuade a second chance from the judges, but when you stand guilty of distributing the phone numbers and encouraging intimidation of those very judges do you really expect them to give you a second chance? Even a kid can understand that. The judges ruled to the letter of the law, that was their prerogative. No amount of money and apology should change that, let him out and next time he could theoretically lead a mob to take them out, seeing as he was able to get away with it the first time. Problem with the reds is they can't seem to understand they are not above the law.

    Collateral estoppel is the legal phrase for issue preclusion, the fundamental concept that once you have litigated an issue before a court and lost, you are not allowed to litigate the same issue again. Doesn't this finality of a court's decision exist in Thailand?

    Is there no limit to how often one can file the same lawsuits and appeals over and over.

    The red shirts are not the only people in Thailand with court cases, and each time they decide to jump the queue other peoples cases get postphoned - again!

    'The court has scheduled Nov 29 for consideration of a petition that it revoke bail for six other red-shirts, including five Pheu Thai MPs'.

    5 MP's ! Crazy immunity law that allows these people to go free, any other country would have banged them up a long time ago.

    I admire the judges for NOT giving in to the shameless intimidation from the justice department. A bail breaker like this red clown belongs in jail!! There IS still justice in Thailand!!

    Why are all these cases not in court already?
    Guilty or innocent these long delays are just bad for Thai justice.
