Phyathai 1 Hospital lawsuit thrown out

Phyathai 1 Hospital on Tuesday lost an appeal in its bid to file a 100-million-baht lawsuit against a medical malpractice activist.
The Supreme Court rejected the hospital's appeal to sue Preeyanan Lorsermwattana, leader of the Network of Victims of Medical Malpractice.
The judge agreed with lower court rulings that Mrs Preeyanan did not intend to tarnish the hospital's reputation 21 years ago when she criticised its doctors on Channel 9.
She alleged that the hospital had disabled her son at birth, as a result of complications during his delivery.
Mrs Preeyanan also filed a suit against the hospital and two of its doctors, requesting 57 million baht in compensation in 1994.
The lawsuit was dropped by the Civil Court and the Appeals Court due to the statute of limitations in the case expiring. The case is still unresolved, pending a final decision from the Supreme Court.
