Court ruling expected soon on whether to allow 3G bid

The Administrative Court is now deliberating whether to order the suspension of 3G licences to the three bid winners.

A decision is expected soon following its two-day inquiry into the bidding process. The inquiry wrapped up yesterday.

The National Broadcasting and Telecommunications Commission (NBTC) is required to issue the licences within 90 days of approving the auction's outcome.

    Why does it always take so long to make decisions in Thailand? It’s always ‘but this and but that’ or ‘if this and if that’ surly the 3G system should have been in place and operating by now? The 3G system is of great benefit to both companies and business people. Come-on guys wake up.

    "NBTC commissioner Suthiphon Thaveechaiyagarn said yesterday that the Office of the Ombudsman's petition was unlawful...The agency failed to ask the NBTC to clarify the allegations before it decided to bring the case before the Administrative Court, he said."

    According to the Organic Act on Ombudsman, BE 2552, the NBTC, as an independent organisation, cannot be summoned by the ombudsman. Further, a clause in the act states that, should there be any problem gathering information, the ombudsman must forward the matter to the court.
