3G case against NBTC dismissed

The National Anti-Corruption Commission (NACC) has dismissed the case in which all four telecommunication commissioners were accused of colluding with operators in the 3G spectrum auction in October 2012.

The four are Col Settapong Malisuwan, chairman of the telecommunication commission under the National Broadcasting and Telecommunications Commission (NBTC), and three other telecom commissioners — Suthipol Thaweechaikarn, Prasert Silphiphat and Gen Sukij Kamasunthorn.   

The NACC found no grounds to the charge that the accused had set the bidding criteria to benefit the three bidders.

It reasoned that based on the same criteria 20 operators could have joined the bid.

It also found DTAC Network, DTAC's nominee for the auction, was not a foreign company as charged, according to Business Development Department data.

The NACC also established that the broadcasting commission was acting on behalf of the NBTC so it was fully authorised to hold the auction.

The bids of all three operators were also in line with the criteria, with no witness or evidence to the contrary.

To the charge that the commission failed to cancel the auction even though it was aware there was no real price competition, the NACC said the auction had enough competition with seven rounds of bidding and the total price was higher than those in other countries with comparable per-capita gross domestic product.
