The Supreme Administrative Court yesterday dismissed a complaint filed by candidates from the New Aspiration and Pracharaj parties asking the court to nullify advance voting held last weekend, and cancel the general election.
The court said the case was not under its jurisdiction as the 2007 constitution says court complaints related to MP or senator elections are under the jurisdiction of the Supreme Court.
The complaint was filed against the Election Commission (EC) by Sarawut Thongphen, secretary-general and zone 3 party-list candidate of the New Aspiration party, Surasee Phatham, zone 4 New Aspiration party-list candidate, and Thanomsak Nualset, zone 6 party-list candidate of the Pracharaj party.
They claimed the EC's organisation of advanced voting on Dec 15 and 16 was unlawful and asked the court to nullify the early ballots and cancel the general election.
Mr Sarawut said he will consult his party's legal team about the possibility of lodging the same complaint with the Supreme Court.
Meanwhile, city clerk Pongsak Semsan said the unofficial result in Sunday's voting for Bangkok will be known by 8pm the same day.
The counting of ballots at each polling station is expected to be completed by 5pm, two hours after polling stations close. Tallies from polling stations will then be added to the results from the advance voting.
He said the ballots cast by city voters on Dec 15 and 16 have been stored under tight, around-the-clock security at 38 district offices, 11 police stations and a school. None of the storage rooms will be opened until 3pm on Sunday, he said.
The city clerk yesterday inspected the storage room for advance ballots at Bang Sue district office along with Pol Col Paisal Khachasap, superintendent of Tao Poon police station.
The room storing the boxes of advanced ballots at Bang Sue district is now guarded by police. Parties fielding candidates in this constituency have also sent representatives to keep an eye on the store room.
