Compensation cases by Government, businesses and citizens

Compensation cases by Government, businesses and citizens

Postby Talingchan on Sat Apr 24, 2010 6:07 pm

There is now an opportunity for civil cases for compensation for red shirt terrorism.

Cases can be launched against Taksin, red shirt leaders and those individual red shirts that have been identified with the violence and lawlessness.

This would bankrupt Taksin, his family and the red shirt leaders and compensate government, citizens and businesses.

Just curious, but how will you sue him if you cannot find him?

You don't have to find anyone to sue them. The usual way is to lodge notices in the press that a law suit has been submitted to the court. If they don't respond they lose.

Taksin and the red shirt leaders have money frozen in bank accounts which can be released to satisfy court judgments.

Service of process by publication works in many countries........but I believe (not certain) that it is different in Thailand and personal presence of defendant is necessary.

In any event, what proof do you have that Thaksin is at fault here? I think that he is.......but can it be proven to a court's satisfaction based upon facts that we now know? Talingchan, I would be happy to hold Thaksin responsible here, but I see many procedural problems.

Money trail is sufficient evidence. Government is already aware of oney transferred to phantoms in shophouses who disappeared. The source of the money can be traced and the culprits exposed and brought to justice.

Thaksin can also be sued in any jusrisdiction he lands in.

While this turmoil is going on, I wonder how many of the "clean" ruling party are in the backroom, puting money in plastic bags and leaving the from the back. It is the perfect time since all eyes are on the Red Shirts. Human (political) nature I guess.

Do we as yet have a proven money trail?

If one was fortunate enough to win then they might discover that collecting is the bigger challenge.
