Pheu Thai has asked the Election Commission to investigate those behind an alleged smear campaign against its No.1 list candidate Yingluck Shinawatra.

Pheu Thai spokesman Prompong Nopparit yesterday lodged a complaint with the poll agency, accusing Kaewsun Atibhodhi and Tul Sitthisomwong of breaching election law.

They are spearheading a campaign seeking legal action against Ms Yingluck over her role in the asset seizure case against ousted prime minister Thaksin Shinawatra, her elder brother.

The Supreme Court ruled in February last year that Thaksin and his ex-wife Khunying Potjaman na Pombejra concealed their Shin Corp shares and controlled the shares through proxies – their adult children and other relatives including Ms Yingluck, who held 20 million shares on Thaksin's behalf. Ms Yingluck gave testimony for the defence.

Ms Yingluck told the Supreme Court's Criminal Division for Holders of Political Positions in Thaksin's 46-billion-baht seizure case that she bought 20 million baht of Shin Corp shares from her brother. At the time she did not have enough money so they drew up a loan contract so it was clear she was not acting as his proxy.

But the court ruled Ms Yingluck held the 20 million baht in shares on Thaksin's behalf, which her critics interpret to mean that she perjured herself.

Mr Prompong said politicians are pulling the strings behind the campaign and urged the EC to take action before voters go to the polls next month.

"These people are the regulars [against Pheu Thai]. Mr Tul is a leader of the multi-coloured group, who tend to support the Democrats. Now he is discrediting Ms Yingluck," he said.

Mr Kaewsun is a former member of the disbanded Assets Scrutiny Committee (ASC) which was set up following the 2006 coup. Mr Tul is the leader of the anti-red shirt Network of Citizen Volunteers Protecting the Land.

According to their 16-page document which urges the public to sign up and support legal action against Ms Yingluck, Mr Kaewsun and Mr Tul claimed the July 3 election is "no ordinary" poll for Pheu Thai.

They noted that Ms Yingluck is being used as a pawn in a scheme to whitewash Thaksin and reinstate him to power.

They are seeking to have Ms Yingluck prosecuted for alleged perjury related to the asset seizure case against Thaksin.

Asked if red shirts who interrupted Democrat leader Abhisit Vejjajiva's campaign should face a similar probe, Mr Prompong said there had been some inquiries into the incidents and some of those involved are imposters.

"I would never agree if red shirts did what Mr Kaewsun and Mr Tul are doing. And as far as I am concerned, I don't think red shirts have crossed the line," he said.

Ms Yingluck said no legal action would be sought against Mr Kaewsun and Mr Tul for the time being, even though she has asked the party's legal team to look into the matter.

She said that she would focus on the campaign and what the party has to offer. "I knew what kind of pressure was waiting when I decided to enter politics. I'll do my part and leave the rest to the legal process," she said.
