The petition, signed by 62 Democrat MPs, was filed by Songkhla MP Wirat Kallayasiri under Section 91 of the constitution.
In the request, the MPs said Mr Yongyuth might now no longer be qualified under Section 102 (6) of the constitution because the National Anti-Corruption Commission (NACC) had ruled he committed a serious breach of discipline in his handling of the Alpine land case and the Interior Ministry's own civil service committee had dismissed him retroactively to 2002, when was deputy interior permanent secretary.
Mr Somsak accepted the petition. He said it would take a week or two to verify all the attached documents before it could be forwarded to the Constitution Court.
Mr Yongyuth was acting permanent secrtary when he approved the illegal sale of a large block of monastic land to the Alpine Golf & Sport company for development as a golf resort.
