The former railway employee who raped and killed a 13-year-old girl aboard a southern train last year did not appeal his death sentence before the deadline passed.

Thai media reported on Monday that Wanchai Saengkhao, the 23-year-old former ex-State Railway of Thailand worker, did not want to appeal at the Supreme Court. The Appeal Court had upheld his conviction and sentence on Sept 14.

The deadline for any petition to the Supreme Court expired Friday. However, the defendant still has the right to seek reduced punishment.

Wanchai raped the girl known as "Nong Kaem" July 6 last year as she slept in a berth on the Nakhon Si Thammarat-Bangkok train. He then strangled her and threw the body out of the carriage.

He told authorities he got drunk with co-workers and was taking methamphetamines. He assaulted the sleeping girl as the train passed Nong Kang station in Sam Roi Yot district of Prachuap Khiri Khan.

Her body was found near Wang Phong station in Pran Buri district. Wanchai was caught with her tablet computer and mobile phone.

Wanchai's former colleague, Natthakorn Chamnan, 20, also was jailed in the case, sentenced to four years for abetting the killer. He did not appeal his Criminal Court conviction.

The State Railway of Thailand paid 8.5 million baht in compensation to the family of the dead girl.
