Cambodia takes control of CATS

Cambodia has taken control of Cambodian Air Traffic Services (CATS), a wholly owned subsidiary of Thailand's Samart Corporation, and appointed a senior Civil Aviation official as its temporary caretaker, Samart said in a statement on Thursday.

Cambodian authorities ejected all Thai employees from their offices at CATS on Wednesday after Phnom Penh filed formal charges against Siwarak Chutipong, a Thai engineer working for the air traffic control firm, accusing him of spying. 

"The caretaker has prohibited Thai expatriates from performing their duties," Samart vice-chairman Sirichai Rasameechan said in a statement filed with the Stock Exchange of Thailand, where the company is listed.

CATS has a 32-year concession (2001-2033) to provide air traffic control services under a build, cooperate and transfer arrangement with the Cambodian government. Revenue from the operation this year contributed about 5 per cent of the group's earnings.

The deal was covered by an investment protection agreement between the two countries, he said. Samart was seeking the government's help to end the problem.

"Samart has been closely cooperating with the Thai government to help negotiations with the Cambodian government for the release of Mr Sivarak and to resolve this incident," the statement, which was issued in Thai, said.

Foreign Minister Kasit Piromya insisted that Cambodia must comply with the law in ejecting Thai nationals from their jobs at CATS, replacing them with Cambodians and seizing  the company's equipment. 

Kasit said any action against the company and its employees must be strictly according to the law and comply with Cambodia's own investment and internal affairs regulations.

"The ministry is waiting for reports from the Thai embassy and we will also have to get clarification from the Cambodian government. If it violates bilateral agreements, then we will find ways to proceed from there," he told reporters.

"Cambodia is a market economy," he added. "Just seizing [a company] would not seem right."

The Foreign Ministry had sent the Consular Affairs Department deputy director-general to see Mr Sivarak's mother in Nakhon Ratchasima. Mr Kasit said Prime Minister Abhisit Vejjajiva had promised Mr Sivarak's mother that he would visit her detained son if possible.

The government had to wait for Cambodia's confirmation of a time for the meeting with Mr Sivarak. The ministry had also hired a lawyer to liaise with Samart about the problem.

"There are, however, no problems with Thai-Cambodian relations," he insisted.

Chavanond Intarakomalyasut, secretary to the foreign minister, denied Puea Thai Party MP Jatuporn Promphan's claim that Mr Kasit had ordered the Thai embassy's first secretary Kamrob Palawatwichai to find out the flight schedule of ousted premier Thaksin Shinawatra.

Mr Chavanond challenged Mr Jatuporn to make public a copy of the tape he claimed to have of the conversation, and slammed Mr Jatuporn's statement as "nonsense".

He said the Foreign Ministry is providing assistance for Mr Sivarak and finding a lawyer to defend him.

The ministry this morning asked the Cambodian government to allow Mr Sivarak's mother to visit her son in Prey Sar prison.

The Thai engineer is accused of "stealing classified information affecting national security" by passing details of Thaksin's and Cambodian Prime Minister Hun Sen's flight plan to an official at the Thai  embassy.

    Seizing a foreign company? Only the most banana of the banana republics would do this. Good luck trying to attract any future foreign investments (non-Thai).

    Since this is clearly a politically motivated event, the Thai government has a responsibility to help Samart receive compensation for this injustice.

    This will act as a warning to anyone who ever considers doing business with a corrupt regime like Hun Sen. He is a spoiled 2 year old child who will take back his marbles and run home the minute something does not go his way.

    This is simply another terrible miscalculation by Hun Sen and his economic advisor. It is a short term gain that will have devastating long term consequences. Every day Cambodia begins to look more and more like the failed state it truly is. Very sad.

    Ohhh... Goddd!!! Mr. Kasit, you sound like very nice guy by reading your statement. You sound like, DO WHAT I SAY, BUT DON'T SAY WHAT I DO, RIGHT? Why don't you tell yourself to do so, YOUR MUST COMPLY AND RESPECT OTHER SOVERIGNTY LAW. Don't use your dirty politic to steal or spy on other country! You got it?
    Well, as I mentioned, Kasit is Kasit. No one can change him. But to let him lead your country, you know the consequence. Seem that Mr. Arbhisit & Suthep have lot of headaches about Kasit. Too bad..., that's your choice.

    As I see, the problem stems from the current Thai government in trying to go about every which way to get Thaksin in order to please the PAD but they are going about it on the wrong paths. And Hun Sen finds every possible to give the current Thai government hell in support of Thaksin.

    To end this politicking, the current Thai government must hold an election now and hope Thai people elect someone that everyone (including Hun Sen) respects, someone Hun Sen is willing to negotiate with and welcomes as a friend.

    Let's bring Thailand back to its happier days.

    Chan, Discussion 4: How do you know that Cambodians are not capable of running air traffic themselves? What are you based this on? Please provide evidents to support your assumption. Let's say you are correct with your assumption. How do you know that Cambodians don't have other nationals providing technical support? Let's stay level-headed and stop with denigrating other people.

    Dear Mr Kasit, it is my view your recent handling of the Thai-Cambodian relations has now lead to this new development regarding CAT pure and simple.

    It seems only your arch enemy Mr Thaksin will soon take the stage and sort it out for Thailand!

    It's a soap opera Thai style, at its best that would be an "Academy Award" nomination if it were filmed! Looking forward to the final cut!

    Wonder if Cambodian staff standing in for Thais are qualified to direct air traffic. Since the Cambodian government handed over the operation to CATS for 32 years. Suddenly they have experts to work. Good luck flying there.

    What a shameless claim!
    Don't treat the people like ignorant fools. we, all, have known that the relation between Thailand and Cambodia is at end of the cliff.

    Seem like Cambodia has not given much information yet, they're just keep silence about the case. What i ve seen so far is that the Thai Government claim this and that, want this and that, jumping around like a big shock.

    Cambodia did so far is that barred the Thai worker from access to the work, it is normal, since they think we are spy. They did not kick them out or really take our the company. So do not threaten them by any ways, it not going to help the poor guy.

    So please the Thai Government, both democrat, and Poeu Thai Party stay cool once in awhile ?

    Samart should closely cooperating with Cambodian government to get rid of the spy since day 1 let alone when the spy get caught red handed and Samart cooperate with spy master to secure release of the spy it not a clever move,Samart undermine Cambodian national security interest that how the Cambodian government see it, you don't take side if you take side that is the consequence you have to pay, let the spy use your company as their base to spy the host country may be not in company knowledge go back and sue thai authority for your lost for using your company without your consent.
