PAD asks EC to dissolve P.Thai

The yellow-shirt Peoples Alliance for Democracy (PAD) on Tuesday submitted a petition to the Election Commission seeking the dissolution of the Pheu Thai Party for being under the directive of fugitive former prime minister Thaksin Shinawatra, who is under a five-year political ban.

PAD spokesman Panthep Puapongpan said he was instructed by PAD leader Sonthi Limthongkul to file the petition.  He was accompanied by Puea Fa Din (For Heaven and Earth) Party secretary-general Samdin Lertbut

My approach on these things is to suspend my disbelief over the bizarre laws that ban entire parties for individual acts or everyone's not so hidden agendas on all sides and try to just assess the legitimacy of these never ending suits, claims and filings on their face.

A few comments are just reactionary and these folks have shown that they will protect their side regardless of the accusations, but most of us seem to agree that whether it is Newin Chidchob or Thaksin Shinawatra, if you are banned from politics, then you should not be openly participating in politics through your proxies... the accusations made here are clearly a set up to discredit the PT victory before it took place and an undermining of democracy, but the accusations are also plainly true. What a mess!

D43, you know very well i mean the yellow shirts, a party that is not answerable to the people, they have no mandate nothing. At least the PT has votes from the people.if a party refuses to stand fr elections and be judged by the people, then they should have NO voice.

Why was the 1997 Constitution (the highest law of the land) thrown out by the military coup and was replaced it with the Constitution written by their appointed people? If reconciliation and forward movement is to take place, this question needs answering for the Thai people?

I wonder how you know why the Democrats left this law in place, "nothing more, nothing less." They specifically stated they could not propose to remove the law while cases were pending against them. This is a true statement; it would be unfair to do so. Whether it's the deepest motivation...? Maybe, maybe not. It's amazing you could know that what they said has "nothing" to do with the reason the law was left in place.

Isn't PAD leader Sonthi Limthongkul a terrorist wanted for the airport seizure?

Why now? Because Taksin is seen as a clear winner in a democratic system. All PAD want is an selected government, not a elected one.

It is about Thaksin but then Thaksin would win the election if he was allowed back. That is called democracy, something many on this forum, along with that tiny little party of elitists, the PAD have very little time for.

What happen to the vote no campaign? everybody going to vote for PT anyway. Poor yellow shirt, why being sore looser?
How many people signed the petition? I can probably count my finger of how many people signed it. You waste all of people time to design placard and now you want PT to disolve. Why dont you ask PT supporters and see what their response to your request?

The PAD leader is referencing Section 68 of the Constitution which states - "No person shall exercise the rights and liberties prescribed in the Constitution to overthrow the democratic regime of government with the King as Head of State under this Constitution"
This in effect means that the Puea Fa Din is using the monarchy for election purposes, which is clearly banned by the EC. "If party executives were involved in the offence or were aware of the offence and had failed to stop it, the candidate's party could face dissolution" - EC commissioner P.N.
