Appeal Court upholds verdict on Klity Creek compensation

KANCHANABURI : The Appeal Court has upheld a lower court's ruling ordering Lead Concentrates Co to pay 36 million baht in compensation to Karen villagers suffering from lead contamination.

The court said yesterday it agreed with the Kanchanaburi Provincial Court which ruled in 2010 that the lead-mining firm was responsible for polluting the Klity Creek in Lower Klity village in Thong Pha Phum district.

    The ruling is certainly a step in the right direction; the question remains will the company pay the money or will they file for bankruptcy. However as long as unscrupulous business people and corrupt and incompetent bureaucrats are not severely punished not much will change but that would be necessary to join the developed countries and enter the 21st century.

    The 1992 Environmental Protection Act does not authorize plaintiffs to ask the court to order polluters to clean up their pollution ? If polluters don't have to clean up their pollution then the law is a waste of time .Its supposed to protect the environment .Are they using the same contaminated water ? The environment isnt a toilet .

    The 'feudal system' is still alive and well in Thailand. Those with wealth and influence can not just walk away from their responsibilities due to a cultural abnormality than was banned nearly eighty years ago. When will Thailand finally move into the 21 st century and give justice to everyone equally.?
