Boonlert, Prasong face rebellion petition

A petition will be filed with the Constitution Court against Gen Boonlert Kaewprasit and Sqd Ldr Prasong Soonsiri for rebellion in connection with a rally by the Pitak Siam Group on Oct 28, former senator Ruangkrai Leekijwattana said on Sunday.

Mr Ruangkrai said he would file the petition directly with the Constitution Court on Monday, Nov 5.

Gen Boonlert's speech made to the rally he organised at the Royal Turf Club clearly instigated the toppling of an administration in a democracy under the monarchy in violation of Article 113 of the Criminal Code.

    #7 So all we have to do if we want to violently overthrow the government is, like the UDD cleverly did, just pretend to call for elections? And even if elections are agreed upon, we just make up some more clever excuses and unreasonable demands and continue with overthrowing the government?

    Sorry - the government openly answers to a convicted criminal running the country by proxy. The rule of law has been discarded by the ruling government, it can try, but will fail, attempting to selectively apply it to defend against warranted opposition.

    @Disc6: You are simply incorrect. Article 113 makes it illegal to threaten to use violence to change the government or the courts. Boonlert said he would welcome a coup. He didn't threatent to launch one, because he is not in a position to do so. So he did not violate Article 113.
