Court rejects petitions to stop rally

The Constitution Court has decided not to accept for consideration three petitions asking it to order the Pitak Siam group to cancel its planned rally on Nov 24, ruling that there is no evidence the organisers plan to illegally topple a democratic administration under the constitutional monarchy.

The petitions, filed by former senator Ruangkrai Leekijwattana, Pheu Thai Party member Singthong Buachum and lawyer Nuengdin Wimuttinant, argued that the rally was in violation of Section 68 of the constitution.

The court said that from its questioning of lawyers who represented Gen Boonlert Kaewprasit, or Seh Ai, leader of the Pitak Siam group, and AVM Vachara Ritthakhani, the group's spokesman, the two had never said that they wanted to "freeze" the country under military rule.

The present government came to power through democratic elections not through "terrorising and burning the city".

"If I had military power in hand, I would have staged a coup. I am now waiting to see how Gen Prayuth Chan-ocha, the army chief, will react to my call...The most important thing to do first is to bring down the government...to topple the government...If a coup did take place, an interim government would be set up. If this was not acceptable to other countries, we could close the country. I don't know for how many years, but the closure should remain until all the bad politicians have been driven away. I have never seen a good politician. Soldiers are needed to take care of the country." Bangkok, Oct 21, 2012

Tripple hurrah for the constitutional court to say no to the silly demands of a group that came to power by terrorizing and burning the city!!!

"We will have a period of caretakers in control. It's like basketball. If there is an accident, can't we have a short timeout of 2-3 minutes? If it's on the time scale of politics, it will maybe be 1 year 2 years 3 years or 5 years, then we can have elections again. If it's just one year [without elections] such as in 2549, it will be ruined because as soon as 'he' leaves he'll be back." - Gen Boonlert, Nov 16, 2012

"The court was given assurances that the planned rally was meant only as a show of force to demand the government's resignation. If the demand was unsuccessfull, the protest would be called off."?

If the elected government can be called to resigned by the demonstrators, there will be no government completes the terms. Accept the lost to define new strategies for winning is the only good one, I think.

It now will be interesting to see if the court has been made a fool of. I recall the UDD protest in 2010 demanding the government step down and hold new elections versus this and other protest demanding the removal of the government by force with no elections provided in return. This is the big difference in the two main protest groups and recent history proves which is more democratic.

Good on the judges for using common sense: two Chai Yo's for them

The Court was told "The rally was not intended to take over state power through illegal means".

PS Please now tell the police and Foreign Minister who in an absolute panic right now.
