Senators oppose charter bill vote

The Group of 40 senators wsays it will seek a ruling from the Constitution Court on whether the government can insist on proceeding with a vote on the charter amendment bill in the third reading.

Senators Somchai Sawaengkarn and Prasarn Maruekapithak, representing the group, announced its intention at a press conference ion Tuesday, reacting to a decision to go ahead with the vote by a working group of the coalition parties.

Mr Somchai said that voting on the bill, which seeks to amend Section 291 of the constitution to make way for the setting up of a constitution drafting assembly (CDA) to rewrite the charter, would go against the Constitution Court's decision on July 3.

D2: Bkposter, simple, the main thing wrong about the '97 constitution is it lets people like Thaksin get so carried away with himself that the only recourse is for a coup, and we all know where that got us. The next (PT sponsored) constitution will revert us to that situation. Let's stop this 'most democratic ever' description since that was relative to the lack of charters previously.

D8: we do get the point, Puea Thai controls the legislative therefore believing they control everything, which is why there's so much resistance to this. Just wait & see the hoo-ha that will escalate as they push this process forward without bi-partisan inp

Discussion 1 whatajoke : please be reiterated that each of the legislative branch, judicial branch and execution branch works independently and does not influence each other's execution of tasks. The recent court's ruling that the government needs to reconsider whether further charter amendment bill is to be proceeded is only a "recommendation". Get the point now?

Thaksin says the Constitution is a minefield. Good. That is how it is meant to be to stop people like him abusing their power. That he does not like it is all the more reason to keep it as it is.

Looking at the way politic is being played at the moment, no sitting government will be able to run effectively for the benefit of the Country. The appointment of members of independent institutions and non-elected senators are 'criss-crossing' resulting in 'judicial strangulation'. The world has rapidly changed, and we need to face the reality and amend the constitution so that any sitting government can response to regional and international threat and competition in a timely manner.

Why does the gov. not amend the charter section by section ?
Because this does not help the big boss in Dubai.

Re: D1 Tell us what you dislike about the 97 constitution? To amend the constitution was a campaign issue so why is it a surprise they would want to change it. The 97 Constitution is cited by many as being the most democratic constitution ever in Thailand and guaranteed the civil liberties of all and if you read both that and the 07 version imposed upon Thailand by the military that was not elected and allowed no opposing viewpoints to be discussed.

It only goes against a recommendation of the court, which is non-binding. As far as the 'Puea Thai' coalition is concerned they are running the show and need not listen to anyone, nada, not the senate, not the constitutional court, not the various players, and certainly not the opposition, because they know that they're trying to pull a fast one. This is how they see democracy. They'll have a referendum when it suits them and they are sure everyone has been 'persuaded' to vote in their favour.
