Gen Chavalit Yongchaiyudh, a former deputy prime minister in the Somchai Wongsawat government, will appear before the Supreme Court's Criminal Division for Holders of Political Position on Aug 2, his lawyer said on Sunday.

He and three other defendants are charged in connection with the dispersal of People's Alliance for Democracy (PAD) demonstrators in 2008.

The case was filed by the National Anti-Corruption Commission. Mr Somchai, the former prime minister, now 70, Gen Chavalit, 87, Pol Gen Patcharawat Wongsuwon, 68, a former police chief, and Pol Lt Gen Suchart Muankaew, 66, a former Metropolitan Police chief, are accused of neglect of duty and misuse of power for ordering police to disperse PAD protesters on Oct 7, 2008.

That day, the PAD protesters laid siege to parliament to prevent the government from delivering a policy statement and to pressure it to resign.

The use of police force to break up the protesters, which involved use of tear gas, caused a number of casualties.

After the last witnesses were examined and Mr Somchai, the first defendant, delivered the closing statement for the defence on June 30 this year, the court scheduled Aug 2 for the delivery of its judgement.

Wipas Jarupong, Gen Chavalit's lawyer, said that although his client is still unwell he will definitely attend the court hearing for the ruling.

He said other defendants, including Mr Somchai, are also expected to appear before the court that day as none of them had requested that the reading of the ruling be postponed.
