Court: Executive decrees constitutional

The Constitution Court on Wednesday afternoon ruled that the two cabinet executive financial decrees challenged by opposition MPs and senators are constitutional.

One of the executive decrees allows the government to seek 350 billion baht in loans for water management projects and flood rehabilitation work.

The other allows the Ministry of Finance to transfer the full responsibility for the 1.14 trillion baht in bailout debt from the 1997/98 financial crisis to the Bank of Thailand's Financial Institutions Development Fund.

The Constitution Court earlier accepted for hearing petitions filed by 128 Democrat MPs and a number of senators asking that it rule on the constitutionality of the two decrees.

The court said its decision was unanimous. All nine judges agreed the decrees were legal.The decrees were issued in the interests and security of the country and could not be avoided, the court ruled.

    bula and johnb.
    You asked for a democracy in Thailand but when the oppisition does what happens in a demcocratic country you cry foul. You can't have it boths ways.

    D1@bula - so remind us who resigned from the Pheu Thai when they lost a similar S184 challenge against the emergency decree during the Abhisit government to borrow 400bn to combat the impact of the global financial crisis. The truth is all sides have used emergency decrees to short cut the proper scrutiny of borrowing and spending in Parliament. We should not overreact when our elected representatives do their proper job to ask if the action is legal or not

    Okay so it was constitutional , would have been surprised if it had been deemed not to be...the question is now is this the end of the Kindergarten behavior by the opposition or will this time waste have to go on ?
    Have stated before and I am happy to repeat that it is time for the opposition to up it's game, present it's own ideas..be creative ... else it will remain in opposition for a long time to come.

    One more blow for the Democrats!

    If AV would be in power, he would make a committee called 'Possible Flood Prevention Bureau' which would take 6 months (minimum) to submit their recommendations to the government. The bill would go to the parliament after 7 months. By that time, Thailand would experience the next severe flooding for the second time in a row.

    Now all those who tried to block the decrees should show responsibility and resign from their position as MP and Senator.
