Boonlert, Prasong face rebellion petition

A petition will be filed with the Constitution Court against Gen Boonlert Kaewprasit and Sqd Ldr Prasong Soonsiri for rebellion in connection with a rally by the Pitak Siam Group on Oct 28, former senator Ruangkrai Leekijwattana said on Sunday.

Mr Ruangkrai said he would file the petition directly with the Constitution Court on Monday, Nov 5.

Gen Boonlert's speech made to the rally he organised at the Royal Turf Club clearly instigated the toppling of an administration in a democracy under the monarchy in violation of Article 113 of the Criminal Code.

    Hopefully the Constitution Court will accept this petition and give a quick ruling. It could provide an opportunity for it to demonstrate its democratic credentials and confound those critics who allege it is little more than a front for maintaining the dominance of the traditional elite. The actual issue is surely a no-brainer - public advocacy of a coup is in direct breach of Article 113 of the Criminal code.

    Dictators and authoritarian governments have often come to power through elections. So, just because there has been an election does not mean a government is not a dictatorship.

    I wouldn't call this government a dictatorship - yet. But free speech, which the Reds claim to be fighting for when they protest against Article 112, includes the freedom to call a government a dictatorship, and also the freedom to call for a coup if one wishes to do so.

    Staging a coup may be a criminal act, but saying that you would like to see a coup is not.

    why you can not accept that this government won a legal election, so its not a dictatorship.
    and second, anyone can demonstrate, no problem, but to call for a civil war and a coup and a military government its criminal.

    Did he file a petition with the Constitution Court against the Red/UDD leaders ?????
