Jatuporn cleared of defamation

The Criminal Court on Thursday cleared leading United Front for Democracy against Dictatorship (UDD) member Jatuporn Prompan of defamation charges filed by former prime minister Abhisit Vejjajiva.

Mr Abhiusit's lawsuit filed on June 11, 2009, stated Mr Jatuporn on May 10 of the same year accused him in a speech made before an audience of more than 10,000 people at a UDD rally of ordering soldiers to shoot people.

Mr Jatuporn's speech at Wat Phai Khiew in Don Muang district damaged his reputation and caused the people to hate him, Mr Abhisit said in the lawsuit.

Now that Abhisit is no longer in power and can't have someone arrested or killed, he has to resort to a multitude of nuisance defamation suits to silence his political opponents.

With or without the speech, I would hate any person(s) order a crack down that kills 92, plus injured 2,000+.

@tomo, What would you know about true facts ? You mean the red attempt to rewrite history ?

A couple of points that need making...
    1) He was found guilty in two cases and not guilty in one... Which means that currently 67% of what he says is classed as defamatory. Still cheering?
    2) Laws in Thailand don't weigh up whether the comments are true or not. Simply whether or not the defamed person's reputation was damaged.

It's that last point that stymied Thaksin's hundreds of defamation cases... It seems his reputation couldn't go any lower.

Justice done, good on you K Jaturporn, after all you where only stating true facts.True facts always hurt.

"it was normal for politicians of two rival parties to attack one another." So slander and libels laws do not apply to politicians. Glad they have cleared that up.

Lost two, won one, difficult then to say for certain if the courts are biased. The justice system has therefore worked for and against Jatuporn, he can't complain.

It would be good if BP listed what these 4 lawsuits consisted off, as far as I know all 4 are about defamation. Was it for 4 different remarks?

  • Discussion 1 : 27 Dec 2012 at 16.421

'The court dismissed the case on the grounds that there was not sufficient evidence to find Mr Jatuporn guilty and it was normal for politicians of two rival parties to attack one another.'

Based on this logic, all political defamation cases should be dismissed. Not sufficient evidence of defamation? If he was defamed, this would de-rail the whole government attack on Abhisit. They couldn't have that could they? The agenda is obvious.
