Panel seeks charter court's end

House study wants to curb judicial 'meddling'

The Constitution Court and the Supreme Court's Criminal Section for Holders of Political Positions, should be dissolved, says a House sub-committee looking into charter amendments.

The sub-committee made the recommendation yesterday after wrapping up a study of proposed charter changes.

Sophon Phetsawang, the panel's chair, said the committee was proposing the abolition of the two judicial bodies because of concerns over the judiciary's alleged interference in politics.

    D 20 - "I thought they liked 1997 constitution that introduced those independent checks and balances" The 97 constitution was scrapped along with the CCourt. The junta appointed a Constitutional Tribunal which again became the CCourt under the 07 constitution but with exactly the same people in place as the Tribunal and the present AG was appointed by the Democrat Government.

    D 22 - I don't mind if the CC is abolished as long as their duties are taken over by some other court but not the supreme court.

    D 23 - It's been that way for many decades, nothing is getting better or worse.

    Reading articles like this and witnessing things like TV programmes being mysteriously pulled one gets the impression that the iron fist is beginning to tighten it's grip on society and through issues like this, sliding inevitably towards a very big STOP SIGN, called a coupe. One hopes not, but the more Government inflicts it's (not the people's) will, without transparent checks and balances, the more the majority will be become dissatisfied and will seek a radical solution.

    D18 Ricefield - Yes we agree here. My point was to change (ie amend) what we currently have to make it better ... as opposed the PTP committee suggestion to throw it out (and thus lead to choice 2 eventually).

    Apparently all they like is an absolute and total control, starting with the bodies that are supposed to keep them in check. Attorney general is a Justice Ministry's appointee and now he will have the sole power to prosecute his bosses? Constitutional tribunal elected by the parliament to pass judgments on that same parliament? How could that possibly go wrong....

    This is surreal.

    D 11 - As I said in D1 - Put all courts under the direct jurisdiction of the Supreme Court so all lower court cases can be appealed. That way the strange and often arbitrary decisions by lower courts would or should be curbed.

    At the moment, there is no check and balance on the 'independent agencies'.

    This cannot be applyied because a constitutional tribunal cannot be sided with a political party majority, it's against democracy....
