Thawil Pliensri is to submit a defence statement to the Supreme Administrative Court on July 26 after Prime Minister Yingluck Shinawatra appealed against the Central Administrative Court's order that she reinstate him as National Security Council (NSC) secretary-general.
Mr Thawil said on Wednesday that the Supreme Administrative Court had instructed him to submit a defence statement on receiving the prime minister's appeal.
He said his statement would ask the Supreme Administrative Court to consider the case quickly, because the matter is not complicated.
Mr Thawil highlighted the fact that he has little more than one year until he reaches retirement age, so if the court gives its verdict after that, or orders any remedial action to be carried out once he is retired, it would make little material difference to his case.
He argued that any delays would set a precedent for dragging such cases out, adding that the majority of government officials who are treated unfairly are both senior and nearing mandatory retirement.
Mr Thawil denied speculation that he would lodge a case against the prime minister with the National Anti-Corruption Commission (NACC) if she failed to abide by the court's order.
Section 157 of the Criminal Court for abuse of power should only be used in the eventuality that big mistakes are made in the country's administration, for example in relation to the rice-pledging scheme or the 2.2 trillion baht loan for infrastructure development projects, he said.
"It would be absurd if the prime minister or the entire cabinet would have to halt their duty because of only a mistake over the transfer of an official," Mr Thawil said.
