CDC devises plan to cement in reform

The charter drafters have approved a proposal to make reform and national reconciliation a legally binding mandate for parliament, the cabinet, courts and other state agencies.

An initial time frame of five years will also be specified with the possibility of one further extension of five years, Constitution Drafting Committee (CDC) spokesman, Kamnoon Sithisaman, said on Tuesday.

There are two options for an extension beyond the initial five years. The first is that at least 50,000 eligible voters petition for a time frame extension for reform and reconciliation. The second is that the cabinet agrees to hold a referendum on whether to extend the time frame by another five years, he said.

This mechanism aimed at addressing the country's problems is new and will be used for the first time in this country, said Mr Kamnoon.

The reform and reconciliation section of the constitution calls for two committees to lead implementation of the work, namely the reform and reconciliation committees. 

The reform committee will propose new laws to bring about reform, Mr Kamnoon said.

It will propose draft laws through a new legislative mechanism in which the bills will go through three readings in the Senate before being forwarded to the House for approval.

If the House of Representatives doesn't pass any bills submitted by the Senate, the upper House will have the authority to insist that particular piece of legislation is passed.

The reconciliation committee, he said, won't have the power to propose new laws but this could change at a later date if necessary. Its work will deal with finding out facts and the causes of conflicts.

Responding to CDC chairman Borwornsak Uwanno's comment that the reconciliation committee should have the authority to propose an amnesty law, Mr Kamnoon said that was Mr Borwornsak's personal opinion.

The CDC does not always do what its chairman thinks is right, he said, trying to calm speculation the real agenda behind this reconciliation effort is to push through an amnesty.

All 36 CDC members intend to make sure the new constitution is truly able to resolve the country's problems.
