Watana: Charges against detained netizens inconsistent

Former commerce minister Watana Muangsook has continued to criticise the National Council for Peace and Order over the arrest and detention of eight people for posts they made on social media.

The charges against them, as mentioned by the NCPO, were being changed "on a daily basis", Mr Watana said in a comment on his Facebook page published on Wednesday.

The eight  were arrested  under the all-powerful Section 44 of the interim charter for alleged violations of the Computer Crime Act.

In his post, Mr Watana said the NCPO spokesman on April 27 said the eight had been taken into military custody and were being held at the 11th Military Circle in Bangkok, and would be detained for no more than seven days.

"Concerning this matter, I posted my opinion that the military had no power to detain the eight because NCPO Orders No 3/2015 and No 13/2016 do not cover alleged offences against the Computer Crime Act," he wrote.

Following criticism, Maj-Gen Vicharn Jodtaeng, the NCPO's legal office chief, filed a complaint against the eight for alleged violation of Section 116 (2) of the Criminal Code and Section 14 (3) of the Computer Crime Act of 2007 for posting caricatures and making fun of Prime Minister Prayut Chan-o-cha on the We Love Prayut webpage. Maj-Gen Vicharn said the posts could lead people to believe the government and the prime minister were incapable of administering the country, Mr Watana said.

"But, the prime minister yesterday [Tueday] said the eight had not been arrested for insulting or making fun of him, but for violating Sections 112 and 116 of the Criminal Code," he wrote on Wednesday.

Mr Watana said the charges, as mentioned by the NCPO and the prime minister, had been changed "on a daily basis".

"If what the prime minister said is true, then the charges filed against the eight early must be false," he added.
