Court suggests BMTA liable for pollution

A Supreme Administrative Court judge on Tuesday recommended that a 2006 lower court decision holding the Bangkok Mass Transit Authority (BMTA) liable for creating air pollution be upheld.

The judge delivered his opinion statement on the civil lawsuit, brought against the city's bus operator BMTA and the Department of Pollution Control by the Foundation Against Air Pollution and for Protection of the Environment (FAAPPE), to the five-member chamber of the Supreme Administrative Court.

The chamber will take the judge’s opinion into consideration and will later make a ruling on the case which can be in favour of or against it.

Now if only they could enforce this. Many city buses still belching black smoke. Just walk along Phloenchit road to see them.

Ironically, pollution is much less since the buses have gone to LPG. Buses belching thick black clouds of smoke thankfully are only a bad memory.

Nearly 10 years to get a sensible decision like this?.....only in Amazing Thailand Why doesn't the BTMA go for all electric vehicles to be in place by 2515 when the ASEAN community (hopefully) comes together then be a leader amongst them all.

They just have to test and report every 3 months?? Would be nice if they took action as well. We all know what the test results will be - you only have to drive behind most of these buses.

I don't know if the reporting is incomplete on this story or not but ...

... the court did not order polluting buses off the roads, nor threaten the BMTA with any punishments should it fail to remove polluting buses from the roads. What is the point of saying the BMTA is liable if nothing happens to them if they don't comply?

Either the court is toothless, or the reporter missed an important part of the story.

And during the last 10 years waiting for the court verdict that is a no brainer for just about everyone on this planet the pollution level must have increased 10 folds.

Took 10 years to finally get a final verdict. Will probably take 50 more years for BMTA to comply.
