NBTC free to issue 3G licences

The Administrative Court on Monday rejected a petition asking it to suspend the issuing of 3G licences, ruling the Ombudsman had no right to bring the case against the National Broadcasting and Telecommunications Commission (NBTC).

The judge ruled that the Ombudsman is not a plaintiff in the matter, so the petition was rejected and removed from the case file.

With the ruling, the NBTC can go ahead with the issuing of the licences within 90 days of the approval of the bidding process, or by Jan 19.

Last month, the Office of the Ombudsman asked the court to suspend the granting of the 3G licences, claiming the auction lacked free and fair competition as required under the constitution.
