Lawyers for Witit Artavatkun are considering legal action against the Government Pharmaceutical Organisation (GPO) board which agreed to dismiss him as the organisation's chief, a source familiar with the issue said on Monday.
The source said the team of lawyers was waiting for the cabinet's approval of the dismissal, expected to be tabled at its meeting on Tuesday.
The lawyers must first get the GPO board's official dismissal document and study the reasons before deciding the next move, the source added.
If the dismissal is considered unfair, Dr Witit could defend his rights through the Administrative Court, the source said.
Dr Witit was axed by the board on Friday, pending the cabinet's endorsement of the decision.
Former chief of the Government Pharmaceutical Organisation Witit Artavatkun was sacked and plans to seek justice from the Administrative Court.
The board claimed that it had conducted its own investigation into Dr Witit's performance in parallel with the probes launched by the Department of Special Investigation (DSI) in February.
On May 1, the DSI accused him of favouring a paracetamol ingredients supplier during a procurement in 2010-2012.
The agency claimed on Thursday that Dr Witit had colluded over prices and committed dereliction of duty in connection with the delayed construction of a 1.4-billion baht vaccine factory.
He also split the factory design contract from a single one into four parts which resulted in unfair competition among the bidders, DSI chief Tarit Pengdith said.
The DSI also claimed Dr Witit had changed the type of vaccine factory from an inactive one to a live attenuated one without seeking fresh approval from the cabinet. These changes led to the construction being delayed.
Based on the DSI and its own investigation, the GPO's board decided on Friday that Dr Witit was considered to have been negligent in his duty in the two cases and dismissed him.
He continues to maintain his innocence.
