PT rejects any decree for poll re-run

The Pheu Thai Party insisted on Sunday that a new royal decree cannot be issued for election re-runs in the 28 southern constituencies which had no candidates running in the Feb 2 election.

Pheu Thai spokesman Prompong Nopparit said it was not possible for a new royal decree to be issued.

He said the royal decree for the Feb 2 polls was still in force and it was the Election Commission's responsibility to call new elections in the 28 constituencies.

Mr Prompong said it was not that there were no candidates to run in the 28 constituencies. The problem was that the candidates were not able to register their candidacy because they were blocked from doing so, and they had filed a complaint over the matter.

Somchai Srisuthiyakorn, the election commissioner in charge of election management, has said it was impossible to hold a fresh election in the 28 southern constituencies which had no registered candidates since the caretaker government and the EC still could not reach a clear conclusion on how to proceed.

Mr Prompong said the matter could not yet be deemed a conflict between the EC and the government as mentioned in Section 214 of the constitution.

He said the EC had the power under sections 235 and 236 of the constitution to hold election re-runs, but tried to leave the responsibility to the government. Mr Prompong proposed that the candidates be allowed to register their candidacy by e-mail.

He said if the government issued a new royal decree it could lead to the Feb 2 election being nullified, the prime minister being subject to both civil and criminal suits, and Pheu Thai facing a dissolution petition filed by the Democrat Party.

The coalition parties - Pheu Thai, Chartthaipattana, Chart Pattana and Phalang Chon - on Friday called for the EC to wrap up the incomplete election process, warning that the country faces the threat of huge economic damage in the absence of a government.

The call was rejected by Mr Somchai.
