Apple expands Samsung hit list

Apple Inc has added Samsung's flagship Galaxy S III smartphone to its hit list as it seeks further curbs on the Korean company's "copycat products".

The Galaxy S III (right) is expected to be Samsung's best-selling smartphone ever, but it's too much like the iPhone 4s, Apple is now claiming.

Apple filed the revised complaint on Friday in US federal court in San Jose, California.

The move followed a $1.05-billion jury verdict on Aug 24 in the same court, which found that Samsung infringed six of seven Apple patents in dispute. In that case, Apple is seeking a US sales ban on eight Samsung smartphone models and a tablet computer.

In its new complaint, Apple alleges that Samsung continues to "flood the market with copycat products". It said Samsung had sold infringing products through August, including its "current flagship device, the Galaxy S III".

US District Judge Lucy Koh in San Jose ruled last Tuesday that based on the Aug 24 verdict, Apple’s request for a permanent ban on US sales of eight Samsung mobile devices would be considered at a hearing on Dec 6.

The judge has scheduled a hearing on Samsung’s request to lift a preliminary sales ban on the Galaxy Tab 10.1 for Sept 20, if she deems it necessary.

Samsung, which denied Apple’s infringement claims in a court filing in April, said in a statement on Friday that it would take the "necessary legal measures" to keep its products available in the US, charging Apple with seeking to "limit consumer choice".

The followin Samsung smartphones are named in the revised complaint: the Galaxy S III, Galaxy Note, Galaxy S II Skyrocket, Galaxy S II Epic 4G Touch, Galaxy S II, Galaxy Nexus, Illusion, Captivate Glide, Exhibit II 4G, Stratosphere, Transform Ultra, Admire, Conquer 4G, and Dart. Other devices covered by the filing are the Galaxy Player 4.0 and Galaxy Player 5.0 media players, and the Galaxy Note 10.1, Galaxy Tab 7.0 Plus and Galaxy Tab 8.9 tablets.

    D4: Let me put it another way directly related to your example of the written word. Plagiarism would be if and when someone simply, say re-writes an entire story from beginning to end, changing names and places only. But there is a catch.

    In literature there are only just over half a dozen basic "plots". Some say "seven basic plots". Those plots are the frameworks within which stories are written. Every novel is not pure invention and creativity. Plots are the structures into which the "creative" potential of writing goes.

    If every writer were disallowed from using the outer framework of story-telling, the available plots, we would have only have seven books currently available on the shelves (think figuratively) What counts is how well the story is woven and told, and makes itself accessible to readers.

    Much like cell phones. The framework may catch the eye like a good book cover, but it is what is inside that counts.

    D4 - It is interesting that Apple gladly uses Samsung patents for cellular connectivity without paying any compensation, but they want massive amounts of money for any Apple patents that Samsung uses. A double standard on intellectual property?

    And some of their claimed "intellectual properties" ... rounded corners, hand gestures ... these have been part of nature since god's dog was a puppy. How can they claim to have created them? While there are some legitimate complaints involved, overall it smells like an attempt to monopolize a market.

    This legal case helped our company make the decision as to which tablet to equip all of our staff with ... Samsung.

    GOD D4: Your analogy is not appropriate. But to turn it on its head...

    What of two people are given the same assignment and the same resource books to work with, and then one hands in his or her report first, and afterward the other. There are bound to be similarities. Cell phones and their designs are the result of research. And it is usually not the person doing the research who has the patent, for example. The company owner does. So "intellectual property" is an oxymoron of sorts.

    You could add HTC Desire ii and a few other phones to the list because how much different can one cell phone be to the others?

    This is about monopoly and the death of free market economy.

    The issue here is not whether SS Galaxy is better than iPhone 5. It's all about intellectual property. Using plagiarism an an analogy, how would u feel if your classmate steals your report, revises it a bit, and gets an A while u receive a C?

    Well, I own an Samsung SII but was actually planning to buy an iPhone. After reading about all the court cases (5 months ago) I decided to Google them next to each other. The choice was easy and swift, SII has MUCH better specs, apps and is much lower in cost. Apple are hanging them selves, why not buy up Samsung, lock stock and barrel?

    A perfect example of the farce that is modern day "free market economy".

    It has just become monopolies fighting it out at the top and the consumer paying the price.

    I have had iPhones, and still do but agree with D1: the Galaxy S3 is the better choice.

    Having had both phones, I can understand APPLE's problem, the Galaxy S3 is far better in everyway!
