Sexual content creators submit legalisation bid

A group calling for the legalisation of pornographic videos and sex toys submitted its proposal to the House Speaker's office at parliament yesterday.

One of its newest members is a young woman who was recently arrested and charged for streaming sexual acts with her boyfriend online to paying subscribers.

Suthanya Nakhonjinda, 19, aka Nong Khai Nao (Miss Bad Egg), was among those who arrived at parliament yesterday to propose the amendment to Section 287 of the Criminal Code.

The section prohibits trade in obscene material, with penalties of up to three years in prison and/or a fine of 6,000 baht.

Ms Suthanya and her boyfriend were arrested in Samut Prakan in September.

The group was led by content creator Attapol Khaithong, who claimed that Section 287 prevents people who deal with sexual content for a living from earning a sustainable and legal income.

The section obstructs occupations and limits individuals' rights to choose what to do with their bodies and lives, he said. The section should be amended to legalise the production, distribution and trading of sexual content and sex toys, he said, adding that such activities could be regulated by the Culture Ministry and Public Health Ministry.

The group submitted their proposal to Sukit Atthopakorn, adviser to the House Speaker. They said they plan to gather more signatures to further bolster their cause.

Police have arrested many people recently for streaming sexual acts online for the benefit of paying subscribers.

In addition to Nong Khai Nao, they include a couple in their 30s, who were penalised for having sex on the side of a road known for its large yang (resin) trees in Saraphi district of Chiang Mai early last month.

Also last month, a transgender woman was arrested in Tak province for allegedly live-streaming sexual intercourse with her boyfriend to paying subscribers in a Line group.

The "sex content creator" saga has reignited the debate between people with conservative values and those who hold more liberal views on how far sexual activities can go under the law.
