Ex-deputy PM Surapong sues election commissioners

Former deputy prime minister Surapong Tovichakchaikul on Thursday filed a malfeasance charge against the five election commissioners for their ruling that he had violated the election law the night before the Feb 2, 2014 general election.

Mr Surapong, who is also a former foreign minister, lodged his complaint at the Crime Suppression Division. 

The Election Commission ruled on Oct 9 last year that he breached the election law prohibiting campaigning and canvassing activities after 6pm the day before an election.

The EC said Mr Surapong appeared on a programme broadcast on state-run NBT television channel after the 6pm, Feb 1, 2014 deadline for the Feb 2 general election.

Mr Surapong said he was travelling from Chiang Mai to Bangkok between 5pm and 7pm on Feb 1.

The NBT channel had rerun a previously broadcast programme at that time, in which he appeared as head of the Centre for the Administration of Peace and Order.   

He submitted boarding passes in his name for flights TG116 and TG103, one departing Bangkok and the other departing Chiang Mai, to the CSD as evidence. Mr Surapong said he brought the malfeasance charge against the five-member panel because it delivered its ruling without calling him to testify.

Asked why he had only now taken action against the EC, and not earlier, he claimed he had needed to collect evidence to present on his behalf. He had requested copies of travel documents from Thai Airways.

The move had nothing to do with the constitution referendum on Aug 7, he asserted. 

The Feb 2 election was disrupted by blockades of polling booths by protesting opponents of the Yingluck Shinawatra government, which resulted in all results later being nullified by the Constitutional Court.
